Supplementary GTC - ARNOLD UMFORMTECHNIK

Supplement to the general terms and conditions

of supply and payment of Arnold Umformtechnik GmbH & Co. KG for the area of additive manufacturing

I. Scope of application

These terms and conditions apply to all business relations of the customer (the "Customer") with Arnold Umformtechnik GmbH & Co. KG ("Arnold Umformtechnik") for products created through the application of additive manufacturing. These terms and conditions apply in addition to the general terms and conditions of supply and payment and take precedence insofar as they stipulate more specific arrangements.

II. Specifications of the customer; Deviations

Within the scope of the ordering process, the customer shall deliver a CAD model or a comparable model to Arnold Umformtechnik which will form the basis for the manufacture of the end products (the "Products"). Arnold Umformtechnik shall not be obliged to check the specifications submitted by the customer. Unless otherwise expressly agreed in writing, Arnold Umformtechnik will manufacture the products exclusively in accordance with the specifications of the customer. The customer bears the responsibility for the design.

III. Additional services provided by Arnold Umformtechnik

Arnold Umformtechnik shall only be obliged to manufacture the products in conformity with the agreed specifications. Arnold Umformtechnik also offers the customer additional individual services, such as in particular the customised optimisation of the products/CAD models for additive manufacturing and the post-processing of manufactured products. The scope of such services is to be agreed between the parties in writing and will, as appropriate, be invoiced separately.

IV. Warranty

Arnold Umformtechnik warrants compliance with the specifications of the customer in accordance with the contractual agreements. In particular, Arnold Umformtechnik gives no warranty that the products are suitable for specific uses. The customer bears the responsibility for the design and the selection of materials. Information concerning the physical and chemical properties of the component materials serves only to assist the customer's own evaluation and assessment of risks, and does not establish any responsibility on the part of Arnold Umformtechnik.
In the case of work to scale, Arnold Umformtechnik warrants the precise setting of the machines. Dimensional differences resulting from shrinkage or expansion of the materials used are reserved. Arnold Umformtechnik shall only be liable for changes that occur subsequently due to external influences, in particular weather, light or humidity, to the extent that these changes are caused by improper work.

V. Industrial property rights

Arnold Umformtechnik is entitled to all copyrights and industrial property rights in the models, moulds, devices, designs, drawings and other data created by it or by third parties on its behalf.
Should any legal rights eligible for protection, in particular patents, arise within the scope of the co-operation between the parties through services provided by Arnold Umformtechnik, Arnold Umformtechnik shall the sole proprietor of these rights.
